      PEJ, Who Advertises on News Sites and How Much Those Ads are Targeted: “A new study of advertising in news by the Pew Research Center’s Project for Excellence in Journalism finds that, currently, even the top news websites in the country have had little success getting advertisers from traditional platforms to move online. The digital advertising they do get appears to be standard ads that are available across many websites. And with only a handful of exceptions, the ads on news sites tend not to be targeted based on the interests of users, the strategy that many experts consider key to the future of digital revenue. – Of the 22 news operations studied for this report, only three showed significant levels of targeting. A follow-up evaluation six months later found that two more sites had shown some movement in this direction, but only some, from virtually no targeting to a limited amount on inside pages. By contrast, highly targeted advertising is already a key component of the business model of operations such as Google and Facebook.

      PEJ, Who is Placing Ads? – “Who is buying ads on news sites? The answer reveals part of the trouble the news industry is having findings its way in the new marketplace. Across these 22 news sites, the biggest single advertiser is the news organization itself or its parent. Ads promoting the organization’s own products, known as ‘in-house ads’ in industry terms, accounted for 21% of the online ads studied – more than any category. … The magazine websites studied here (time.com, newsweek.com, economist.com and theatlantic.com) ran the largest percentage of in-house ads, fully 50% overall, from economist.com at 40.1% on the low end to time.com at 56% at the high end. In the print version of these magazines, by contrast, 10% of the ads were promoting the magazine or its company (Time magazine 11%, The Economist 13%, Newsweek 4%, and The Atlantic’s print edition contained no self-promoting ads). – Newspapers contained the second-highest level of self-referencing advertising, 21% of the Web-based ads versus 9% of their print ads. … For these print-related outlets, though, the heavy reliance on self-promoted ads could reflect two different factors. First, the newspaper industry still relies on its print product for the vast majority of its ad revenues. At the end of 2010 (the latest data available) fully 88% of overall newspaper revenue came from the print product versus just 12% from the Web. … Another phenomenon could be the inability of the industry to draw advertisers-and thereby ad revenue-to their online space.

      PEJ, The Financial Industry: “The second biggest category of advertising online was one that played a fairly small role for news in legacy platforms, the financial industry. Ads for financial products or services accounted for 18% of all Web ads captured, more than triple that of the next biggest category, toiletries and cosmetics (5%). And on more than half of the sites, 12 out of 22, financial ads ranked first-above self-promotion. … These numbers stand in contrast with the small role financial advertising plays in most of the legacy platforms studied. Only magazines contained more financial industry advertising in their original platform than online.

      PEJ, Targeting: “The customization or targeting of ads based on audience data is one of the newer ways to serve advertisers interests-helping those selling goods to reach consumers perceived to be the most likely to be interested in and thus to act on their ads. In targeted advertising, in other words, the ads one person gets will differ from what another person receives, depending on their online purchase history, location and/or personal habits, even if they click on the same website at essentially the same time. … Overall, only a handful of sites exhibited high levels of targeting. A few more had a moderate level of targeting. Most showed no signs of targeting at all. … Overall, just three of the 22 sites exhibited high levels of targeting, defined here as at least 45% of the ads were different from one user to the next. … One question that emerges is whether targeting has more or less natural appeal on some websites than others. In other words, do national sites with their larger and more diverse audience pools lend themselves more naturally than smaller sites to the benefits of ad targeting? … Finally, on a few sites, there was evidence of another method of targeting-not according to users but according to news story. On a number of occasions, there was a close relationship between the content of the story and the ads displayed.

      PEJ, Use of Discount Sites/Coupons: “About half of the sites studied, 16 of the 22, carried some discount/coupon advertising. But on only five did discount ads make up more than 10% of all the ads studied. For the most part, sites that created their own discount programs tended to rely on these ads more. … Among nationally oriented sites, Yahoo News carried the greatest percentage of discount/coupon advertising, 15% of the ads studied. The majority of these were from the national services Groupon and LivingSocial. – The other two sites with the highest use of discount advertising, the Toledo Blade and Los Angeles Times, have created their own daily deal operations to compete with the national companies. … These were the only two sites in our sample that had tried their own daily deal style business, but they are certainly not alone. Various papers now have their own Groupon-like services…”

      PEJ, Format: “That leaves banner ads, classifieds, video and rich media as the four main kinds of ads news sites can offer advertisers. – Banner ads, the oldest form of advertising on the internet, make up the second largest percentage of ads on the internet (24% of total online advertising revenue). Going forward, most market analysts expect banner ads will represent a smaller portion of online advertising than search, but the category is still expected to grow. For instance, eMarketer predicts that banner ads will increase from $7.6 billion in 2011 to $11.7 by 2015, a bright spot for the news online. … Across these 22 news sites, that same tendency toward banner ads emerged; static banner ads made up nearly half (46%) of all the ads on news websites. Some differences in the style of ads used did emerge-mostly according to the legacy media genre, though individual sites did at times stand apart from their media brethren. … The Washington Post, on the other hand, relied on banner ads for just 18% of the ads studied. Instead, the site used sponsored links far more than others, 66%. Two other national papers, USA Today and the Los Angeles Times, also used sponsored links more than static banner ads.”

      Apple: “iBooks Textbooks for iPad. – Introducing an entirely new kind of textbook that’s dynamic, current, engrossing, and truly interactive. A textbook created by publishers using a new authoring tool from Apple. A textbook brought to life by iPad. … For hundreds of years, textbooks have put a world of knowledge in the hands of students. But while the way people learn has changed dramatically, the traditional textbook has stayed the same. … Today’s students have grown up completely immersed in technology. iPod, iPad, computer – these are the ways they interact with their world. They need a textbook made for the way they learn. … A Multi-Touch textbook on iPad is a gorgeous, full-screen experience full of interactive diagrams, photos, and videos. No longer limited to static pictures to illustrate the text, now students can dive into an image with interactive captions, rotate a 3D object, or have the answer spring to life in a chapter review. They can flip through a book by simply sliding a finger along the bottom of the screen. Highlighting text, taking notes, searching for content, and finding definitions in the glossary are just as easy.       GigaOM: “Textbooks in iBooks 2 also incorporate highlighting, note-taking, and interactive Q&A sections at the end of each chapter, which also provide immediate feedback; no more hunting for a key in a separate book or appendix to see how you did. Notes and highlights are automatically turned into flashcards for study purposes. In short, it looks like Apple has taken a lot of the best aspects of services like Inkling and Kno and integrated them into its own product. – The new textbooks reside in a dedicated iBookstore category, and will offer free samples before you buy. The iBooks 2 app is free, and is available today via the App Store. Textbooks will be priced at $14.99 or less, and initially be aimed at the high school market. That’s some seriously competitive pricing, and Apple’s initial partners are Pearson, McGraw-Hill and Houghton Mifflin Harcourt, which together are responsible for 90 percent of textbooks available, according to Schiller.”

      TC: “This move is centered around reinvent the textbook. Schiller explained today that Apple sees textbooks as amazing devices, but they’re heavy, not searchable or durable. According to Apple the iPad is the perfect counter. It’s portable, durable, interactive, searchable, current and capable of containing even richer content. … This announcement puts Kno in a bad position. iBooks 2 packs many of Kno’s prime features into a native iPad app. Kno might have the edge with content, though. The company has long worked with the top education publishers and has an impressive library of textbooks. Kno, as a 3rd party app, has the advantage of being able to embrace other platforms like the web and Android where iBooks 2 will likely remain only on the iPad.

      GigaOM: “iBooks Author comes with a template choose to help you get started quickly, and then you can click and drag your own media to add images, video, audio and other content to your book. You can even add things like 3-D models, which we saw demoed in the iBooks 2 unveiling earlier, as well as interactive elements like image galleries. … Amazingly, Apple’s iBooks Author is free, and is available today on the Mac App Store. This will definitely help attract content creators to the iBooks platform, and could also seriously impact the ability of competitors to sell publishing suites aimed at doing similar things.

      TC: “All the magic happens in a new OSX application called iBooks Author, which gives users a simple way to integrate different types of media in order to create iBooks of any stripe. What’s more, iBooks Author will be available today for free, so all you aspiring iBook creators can get started post haste. … That’s all well and good, but the real meat here is the ability to add interactive elements to an iBook with minimal headaches. Presentations created in Keynote can be dragged directly into iBook Author for inclusion as an interactive widget, and those who have worked with HTML and JavaScript can create more robust widgets on their own. Also included are a nifty glossary creation tool (essentially a two-click process), and the ability to publish the iBook directly into the store.

      Apple: “iTunes U – If you’re an educator at a university, college, or K-12 school, now you have an easy way to design and distribute complete courses featuring audio, video, books, and other content. And students and lifelong learners can experience your courses for free through a powerful new app for iPad, iPhone, and iPod touch. … The free iTunes U app gives students access to all the materials for your course in a single place. Right in the app, they can play video or audio lectures. Read books and view presentations. See a list of all the assignments for the course and check them off as they’re completed. And when you send a message or create a new assignment, students receive a push notification with the new information. … The iTunes U app integrates with iBooks, iCloud, and other apps to make it easy for students to keep up with your course. For example, new iBooks Textbooks2 and other books for the course are available right from the app, where students can tap them to start reading the assigned chapter. Notes taken in iBooks are consolidated for easy reviewing in the iTunes U app. If an assignment includes watching part of a video, one tap goes straight to a specific spot in the video. And iTunes U keeps documents, notes, highlights, and bookmarks up to date across multiple devices.

      VB: “I can’t remember the last time anyone was so interested in education technology, but leave it up to Apple to whip up excitement. The company held an ‘education related’ event at New York City’s Guggenheim Museum today, where many expected it to take on the textbook industry with new, interactive e-books. … But Apple isn’t done yet. Eddy Cue, Apple’s SVP of Internet Software and Services, came on stage to discuss how the company is going to help teachers ‘reinvent the curriculum’ with iTunes U, a service that lets students download lectures and other materials from iTunes. Cue says Apple has seen over 700 million downloads from iTunes U, and that it has mostly been used for lectures. … All of this is very exciting, but it’s strange that Apple made no mention of how students can more easily get a hold of iPads in the classroom. While cool, Apple’s plans to reinvent education could leave a lot of students out in the cold.

      NJL: “The day the bookshelf shook: Four lessons for news orgs from today’s Apple iBooks announcements – The focus was on education, and Apple faces some significant hurdles in getting their products into actual schools (where textbook and technology purchasing are constricted by forces bureaucratic, fiscal, and otherwise). But in truth much of what Apple announced was squarely aimed at further disruption of the publishing industry – in this case, the book publishing industry, already facing disruption from Amazon and ebooks more broadly. … How will news organizations react to that newfound ease of publishing? … In the print book era, deciding to try one of these ideas would involve estimating the potential audience, deciding whether it’s worth investing the time to design it, guessing at a print run, figuring out how to get it in the hands of local retailers, and a host of other complications. But with ebooks – if publishing those ebooks is uncomplicated, just a few more steps than hitting File -> Save As…, built around common templates – what kinds of value could be unlocked? … Once books stop being only finished, whole things – when they can also be works in progress, works in development – the possibilities for journalists open up. … I can’t imagine news organizations need any further evidence that reading is going to keep moving from big screens to smaller ones, from stationary to mobile. But judging by a lot of news sites’ abysmal mobile experiences, maybe they do. So here’s one more data point: Apple’s investing big in a creating a new kind of reading experience for a new kind of content, and they’re completely ignoring every desktop and laptop computer in the universe.

      RWW: “In his official biography of Apple’s late cofounder, Walter Isaacson revealed that in addition to television and photography, one industry Steve Jobs was hoping to revolutionize next was textbooks, which he saw as being ‘ripe for digital destruction.’ – Today’s demonstration very much echoed Jobs’ vision for textbooks, which he saw as cumbersome, heavy and slow to update. … This is not an all together shocking direction for Apple to move into, considering its somewhat recent foray into e-books with iBooks and how the iPad is already being used for educational purposes. That the tablet form factor makes for a potentially excellent educational tool is not at all a new concept, and it’s one that Apple has already been using to help sell the iPad pretty much since day one.

      RWW: “It’s hard to wrap my brain around the cold cynicism of Apple’s releasing a new tool to democratize the publishing of eBooks today, only to include in the tool’s terms and conditions a prohibition against selling those books anywhere but through Apple’s own bookstore. There’s just something so achingly awful about it. … Here’s section 2b of the End User License Agreement of the new iBook Author program. ‘B. Distribution of your Work. As a condition of this License and provided you are in compliance with its terms, your Work may be distributed as follows: (i) if your Work is provided for free (at no charge), you may distribute the Work by any available means; (ii) if your Work is provided for a fee (including as part of any subscription-based product or service), you may only distribute the Work through Apple and such distribution is subject to the following limitations and conditions: (a) you will be required to enter into a separate written agreement with Apple (or an Apple affiliate or subsidiary) before any commercial distribution of your Work may take place; and (b) Apple may determine for any reason and in its sole discretion not to select your Work for distribution.’”

      GigaOM: “It’s possible that Apple is planning to open up its new iBook textbooks, either by embracing the ePub standard or making it easy to move texts out of its system and into another, so that iBooks can live alongside Inkling textbooks or CourseSmart books or Kno books — but if it is planning to do that, we didn’t hear anything about it on Thursday. All we heard was how Apple wants to do the same thing to the textbook market as it has done to recorded music and mobile gaming: that is, own and control it.

      Wikipedia: “Today, the Wikipedia community announced its decision to black out the English-language Wikipedia for 24 hours, worldwide, beginning at 05:00 UTC on Wednesday, January 18 (you can read the statement from the Wikimedia Foundation here). The blackout is a protest against proposed legislation in the United States – the Stop Online Piracy Act (SOPA) in the U.S. House of Representatives, and the Protect IP Act (PIPA) in the U.S. Senate – that, if passed, would seriously damage the free and open Internet, including Wikipedia. … My hope is that when Wikipedia shuts down on January 18, people will understand that we’re doing it for our readers. We support everyone’s right to freedom of thought and freedom of expression. We think everyone should have access to educational material on a wide range of subjects, even if they can’t pay for it. We believe in a free and open Internet where information can be shared without impediment. We believe that new proposed laws like SOPA – and PIPA, and other similar laws under discussion inside and outside the United States – don’t advance the interests of the general public. You can read a very good list of reasons to oppose SOPA and PIPA here, from the Electronic Frontier Foundation. … On January 18, we hope you’ll agree with us, and will do what you can to make your own voice heard.

      BoingBoing: “On January 18, Boing Boing will join Reddit and other sites around the Internet in ‘going dark’ to oppose SOPA and PIPA, the pending US legislation that creates a punishing Internet censorship regime and exports it to the rest of the world. Boing Boing could never co-exist with a SOPA world: we could not ever link to another website unless we were sure that no links to anything that infringes copyright appeared on that site. So in order to link to a URL on LiveJournal or WordPress or Twitter or Blogspot, we’d have to first confirm that no one had ever made an infringing link, anywhere on that site. Making one link would require checking millions (even tens of millions) of pages, just to be sure that we weren’t in some way impinging on the ability of five Hollywood studios, four multinational record labels, and six global publishers to maximize their profits.”

      SOPA Strike: “On January 18th, 2012 the internet is going on strike to stop the web censorship bills in Congress! Now is our moment – we need you to do everything you can, whether you have a website or not. … January 18th is going to be amazing. Sites are striking in all different ways, but they are united by this: do the biggest thing you possibly can, and drive contacts to Congress. Put this on your site or automate it by putting this JS into your header, which will start the blackout at 8AM EST and end at 8PM EST. … On Jan 24th, Congress will vote to pass internet censorship in the Senate, even though the vast majority of Americans are opposed. We need to kill the bill – PIPA in the Senate and SOPA in the House – to protect our rights to free speech, privacy, and prosperity. We need internet companies to follow Reddit’s lead and stand up for the web, as we internet users are doing every day.

      TC: “Wikipedia’s Jimmy Wales wanted to send a ‘big message’ to the U.S. government regarding the two heinous internet censorship bills currently being considered, and after a brief period of debate the world’s encyclopedia will soon do just that. – The Wikipedia founder announced on Twitter today that starting at midnight on Wednesday, January 18, the English language version of the world’s encyclopedia will go dark for 24 hours in protest of SOPA and PIPA. With their commitment confirmed, Wikipedia will be joining a slew of websites and companies that will suspend their operations for one day in an effort raise awareness around the two bills. … Though the event is meant to raise public awareness over two critical pieces of legislation, Wales still took a moment to offer a bit of sage advice for students heading back to school: ‘Student warning! Do your homework early. Wikipedia protesting bad law on Wednesday!’

      UN: “Report of the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression – This report explores key trends and challenges to the right of all individuals to seek, receive and impart information and ideas of all kinds through the Internet. The Special Rapporteur underscores the unique and transformative nature of the Internet not only to enable individuals to exercise their right to freedom of opinion and expression, but also a range of other human rights, and to promote the progress of society as a whole. Chapter III of the report underlines the applicability of international human rights norms and standards on the right to freedom of opinion and expression to the Internet as a communication medium, and sets out the exceptional circumstances under which the dissemination of certain types of information may be restricted. Chapters IV and V address two dimensions of Internet access respectively: (a) access to content; and (b) access to the physical and technical infrastructure required to access the Internet in the first place. More specifically, chapter IV outlines some of the ways in which States are increasingly censoring information online, namely through: arbitrary blocking or filtering of content; criminalization of legitimate expression; imposition of intermediary liability; disconnecting users from Internet access, including on the basis of intellectual property rights law; cyber-attacks; and inadequate protection of the right to privacy and data protection. Chapter V addresses the issue of universal access to the Internet. The Special Rapporteur intends to explore this topic further in his future report to the General Assembly. Chapter VI contains the Special Rapporteur’s conclusions and recommendations concerning the main subjects of the report.”

      Wired: “U.N. Report Declares Internet Access a Human Right – A United Nations report said Friday that disconnecting people from the internet is a human rights violation and against international law. – The report railed against France and the United Kingdom, which have passed laws to remove accused copyright scofflaws from the internet. It also protested blocking internet access to quell political unrest… The report, by the United Nations Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression, comes the same day an internet-monitoring firm detected that two thirds of Syria’s internet access has abruptly gone dark, in what is likely a government response to unrest in that country.”

      Cerf, NYT: “Internet Access Is Not a Human Right – It is no surprise, then, that the protests have raised questions about whether Internet access is or should be a civil or human right. … In June, citing the uprisings in the Middle East and North Africa, a report by the United Nations’ special rapporteur went so far as to declare that the Internet had ‘become an indispensable tool for realizing a range of human rights.’ … But that argument, however well meaning, misses a larger point: technology is an enabler of rights, not a right itself. There is a high bar for something to be considered a human right. Loosely put, it must be among the things we as humans need in order to lead healthy, meaningful lives, like freedom from torture or freedom of conscience. It is a mistake to place any particular technology in this exalted category, since over time we will end up valuing the wrong things. … Indeed, even the United Nations report, which was widely hailed as declaring Internet access a human right, acknowledged that the Internet was valuable as a means to an end, not as an end in itself. … While the United States has never decreed that everyone has a ‘right’ to a telephone, we have come close to this with the notion of ‘universal service’… Improving the Internet is just one means, albeit an important one, by which to improve the human condition. It must be done with an appreciation for the civil and human rights that deserve protection – without pretending that access itself is such a right.

      GigaOM: “Cerf’s position is somewhat surprising because, as even he acknowledges in his piece for the NYT, the events of the ‘Arab Spring’ in 2011… Cerf is also the ‘chief Internet evangelist’ at Google, so it seems a little odd he would be downplaying the need for widespread internet access and the benefits that it brings to society. … In a nutshell, Cerf’s argument seems to be that if we define Internet access itself as a right, we are placing the focus on the wrong thing. The ‘Net, he says, is just a technological tool that enables us to exercise other fundamental rights, such as the right to free speech or access to information – and rights should not be awarded to tools, but to the ends that they enable us to reach. … The Internet is a fundamental method of communication and connection, and is becoming more fundamental all the time, as we’ve seen in the Middle East and elsewhere. Seeing it as a right is an important step towards making it available to as many people as possible.

      TL: “As I noted in my earlier essay, the best universal service policy is marketplace competition. When we get the basic framework right – low taxes, property rights, contractual enforcement, anti-fraud standards, etc. – competition generally takes care of the rest. But competition often doesn’t develop – or is sometimes prohibited outright – in sectors or for networks that are declared ‘essential’ facilities or technological entitlements. … So, while I appreciate and agree with Cerf’s humorous point that ‘Today, if I were granted a right to have a horse, I’m not sure where I would put it,’ the more interesting question is this: If government would have decreed long ago that everyone had a right to a horse, would that have meant everyone actually got one? … These are the sort of questions rarely asked initially in discussions about proposals to convert technologies or networks into birthright entitlements. Eventually, however, they become inescapable problems that every entitlement system must grapple with. When we discuss the wisdom of classifying the Internet or broadband as a birthright entitlement, we should require advocates to provide us with some answers to such questions. Kudos to Vint Cerf for helping us get that conversation going in a serious way.

      TC: “So, is the internet a human right? It is our best and most effective way of achieving a universal freedom of expression, and it should be treated as such. But to enshrine it, as others have said, as a human right when it is in fact merely a powerful enabler thereof, is an unnecessary step. Laws and regulations, and things like UN guidelines, should be aimed at enshrining rights in their pure and timeless forms, not in derivative forms, however widespread and important those derivatives may be.

      TR: “It might be argued that internet access was a civil right, since it is something that people look to governments to provide as a matter of course. But even this argument is shaky, he warns. Instead we should look not to the technology, but to the technology industry, to protect human rights, and it is up to engineers to ensure universal, safe internet access. … Cerf, whose current day job is being an internet evangelist for Google, may well have a point. But based on current evidence, there’s a mixed record from the technology industry thus far, not least from Silicon Valley itself. … From a technical perspective, El Reg suspects that Cerf has it right: the internet is no more a human right than a road or telephone. But looking to a relatively amoral industry like technology to act as a human rights guardian is asking for trouble.

      CP: “On November 30, United States District Judge Marco A. Hernandez of the U.S. District Court for the District of Oregon, Portland Division, ruled against a blogger, Crystal Cox, who had represented herself before the court in a defamation case in which she was the defendant. In the end, the judge ordered Cox to pay $2.5 million in damages to the plaintiffs. …Judge Hernandez suggested that bloggers could only sometimes count as journalists, based on a multi-factor test he set forth. … Judge Hernandez also ruled that, under Oregon law, Cox did not have the right to protect her sources. … In sum, Judge Hernandez should have taken a functional approach, and read the terms of the two statutes to encompass methods of publication that were closely analogous to those listed in the statute. Doing so would have meant that blogs, including Cox’s, were included. … On one hand, Judge Hernandez was surely reasonable to include factors referring to practices such as fact-checking… But on the other hand, it may not be fair to include the factors of journalism education, institutional affiliation, or proof of credentials… Yet, to establish such a credentialing body might prove to be a double-edged sword. One of the very points of blogging is that anyone can do it, and that is also one of its great virtues. Thus, this issue may be one in which either bloggers’ independence will be sacrificed a bit, or the legal protections journalists enjoy will continue to be withheld from bloggers.

      Hernandez: “Defendant fails to bring forth any evidence suggestive of her status as a journalist. For example, there is no evidence of (1) any education in journalism; (2) any credentials or proof of any affiliation with any recognized news entity; (3) proof of adherence to journalistic standards such as editing, fact-checking, or disclosures of conflicts of interest; (4) keeping notes of conversations and interviews conducted; (5) mutual understanding or agreement of confidentiality between the defendant and his/her sources; (6) creation of an independent product rather than assembling writings and postings of others; or (7) contacting ‘the other side’ to get both sides of a story. Without evidence of this nature, defendant is not ‘media.’

      Forbes: “In case involving self-described ‘investigative blogger’ Crystal Cox, Judge Hernandez ruled that in order to qualify for basic First Amendment protections like state shield laws, freelance journalists have to meet a rather stiff set of criteria. … On page 9 of a 13-page ruling, Judge Hernandez last month set out these requirements to qualify as a journalist… ‘Without evidence of this nature, defendant is not ‘media,” the ruling says. Obviously, the judge – an Obama appointee – doesn’t understand either media or the First Amendment. His ruling also went much farther than the case before him required. … Hernandez’ qualifications suggest that only ‘news reporting’ is journalism. … Does this mean I think everyone who publishes a blog qualifies for whatever ‘journalistic protections’ exist? Hell no. My opinion is that Crystal Cox isn’t committing journalism on the two blogs I’ve seen associated with her – this one and this other one. I am not taking sides, but her writing and sites would get most ‘real’ journalists fired. This is an example of where journalism and pornography are both hard to define, but I know them when I see them. … Judge Hernandez missed the point in several ways, but he is right that no single attribute can define who qualifies for special journalistic protection and who does not. The First Amendment applies to all, but the law can help journalists in cases of slander and libel, protection of sources and access to news events.

      NYT: “Everyone knows that you no longer need to buy ink by the barrel to be considered a publisher. Your grandmother can do it with a laptop. But can anyone be considered a journalist? That is the focus of the Cox ruling. It suggests that a journalist may need to act on a set of professional standards to be recognized as a protected member of the tribe. – So who is a journalist? A journalist – good or bad – possesses a hunger to pursue the truth and to share it in compelling ways. Yet some of the best journalists have had no academic training in the field. – Blogs compete with mainstream media every day. In some cases, they have become more trustworthy as sources of information than some old school practitioners. … The First Amendment is not just for journalists. It affords all Americans the right to unfettered speech. We should celebrate how technology lets us express more speech than ever before – without discriminating against the ‘non-journalists.’ That doesn’t mean that online publishers should not be judged according to an evolving set of standards and practices.
